Deeds – Registration and Records of Land Ownership and Rights
There are two main functions for the Deeds Office in South Africa. The first is the registration of property and land and the rights pertaining to that land. This function is only necessary when land is bought and sold or when physical land changes hands.
The second function of the Deeds Office is to provide information regarding the ownership of land to any person seeking the information. This provision of information is supplied by the office at a small fee that is payable in advance to the deeds office. There are, however, a number of other companies that provide the information on an outsourcing basis.
The main reason why these types of companies exist is because it can be quite time consuming and frustrating to deal with the Deeds Office and to obtain the information regarding a specific property or land. Information can take weeks to access and the outsourcing companies have a means to access the specific information that is required quickly and conveniently.
The information obtained from the Deeds Office is used for a number of reasons. The most common of these reasons is for people wishing to buy a property. Information regarding the owner of the land as well as the value and outstanding debt on the land is available from this government office.
Another reason people often access deeds is to get the original plans of any structures that exist on the property. This is necessary whenever a new structure needs to be built on a property or when and changes or additions need to be made to the existing structures on the property. The Deeds Office cannot deny any person access to the records held by them for any reason whatsoever unless there has been a failure to pay the necessary fee involved.
